Terms and Conditions

These Terms and Conditions apply to the services which are provided by Kerbi, the trading name for Jasmine Technologies Limited of 11 Claylands Place, London, SW8 1NL (“Kerbi”, “our”, “us” or “we”) to a user of the Kerbi App (the “App”) and any orders for repair services which are made using the App.  Any references in these terms and condition to “you”/”your” refer to a user of the App (including any party who places an order via the App).

  1. Our Services
    1. The Kerbi service allow you access quotations for real time puncture repair and other minor bike repair services (the “Repair”) as offered from time to time from a large number of fellow cyclists, bike couriers and bike repair shops that have registered with us.  In these terms of use, we refer to these people as the “Provider”. Each Provider’s suitability is verified by us ensuring their identification address and Criminal Records bureau Check are confirmed to our satisfaction.
    2. The Repair is undertaken by the Provider.  Whilst your contract for the Repair remains between you and Kerbi, the App enables you to speak to or text the Provider in order to deal with issues in real time. In addition, if you have any queries or issues about a Repair any order you place, you should first contact the Provider and if not resolved then contact Kerbi as detailed below.
    3. When you request a quotation for a Repair, you will then be provided with a range of quotations to choose from. We will provide the Repair to you using reasonable skill and care and have vetted the experience of the registered Providers.
    4. Please note that our App allows for the automated placing of orders without any human intervention by Kerbi.  In other words, we do not 'check' your Quote Request before it is placed with the Providers.  It is therefore essential that the information included in the order is correctly entered and declared in order for the correct Repair and pricing to be displayed. Quotations will be based on the information you provide when placing your Quote Request.
    5. Our order process contains a check box that must be ticked before you accept a Quote to state that you have understood these Terms. The contract between you and us is binding when you accept a Quote. Before a Quote Acceptance and thereby placing your order, you should read these Terms (and all related information which is linked to as part of the Quote Request and Acceptance process, including, for example, the relevant FAQ's section) to ensure that you understand the terms on which we provide the Repair.
  2. Definitions

    Listed below are defined terms which will have the following meanings in these terms of use:

    Acceptance Period means the period a Quote remains available for acceptance, after which it will lapse

    Provider means the third party courier which carries out the Repair.

    Quote a quote received from a Provider for the provision of the Repair in accordance with these Terms

    Quote Acceptance where you accept a Quote and enter into a binding agreement for the delivery of the Repair.

    Quote Request a request by you for Quotes for the provision of a Repair.

    Repair means the puncture or other minor bicycle repair service available form time to time provided by the Provider in accordance with these Terms. Repair can either mean a replacement of the inner tube or patching the existing inner tube using a puncture repair kit.

  3. Placing an Order
    1. Kerbi is not obliged to provide quotations when you make a Quote Request. A contract for a Repair will only be formed when we provide Quotes and you then make a Quote Acceptance within the Acceptance Period specified with each such Quote. At this stage the payment will be processed. Kerbi reserves the right to refuse and cancel any order and operate Payment & Fraud security checks.
    2. Kerbi can only accept orders online from UK residents, who must be the end user and not another third party broker. A UK registered card or Stripe Account must be used to purchase in order to ensure VAT is applied correctly and any refunds / credits due can be applied.
    3. Kerbi will arrange the Repair through the Provider as chosen by you at the time of the Quote Acceptance. The contract between us is not binding until you click upon a Quote Acceptance, at which stage the payment process will take place.
    4. By accepting a Quote, you consent to the provision of the Repair and accordingly from the point of acceptance you will not be able to exercise any cancellation right.
    5. Upon Quote Acceptance your payment will be processed and your Order will be confirmed by email and/or SMS.
    6. There are two types of puncture repair. The first is a replacement of the inner tube. The provider, when possible, can the replace the damaged inner tube for a new one. You will be charged for the inner tube plus the a service cost for the replacement. The second is patching the inner tube where the provider patches the existing inner tube with a puncture pair kit. When you receive quotes you will be able to see whether a given provider is offering a replacement service or a patch service.
  4. Charges
    1. All prices quoted on the App are in pounds sterling (£).
    2. Payment is made at the time of ordering using a valid UK credit / debit card or by Stripe account. Payment is taken by our automated system upon your Quote Acceptance.
    3. Please note that in addition to the charges which are quoted at the time of your order, surcharges may also be payable by you.  Further details are set out in section 5 below.
  5. Surcharges
    1. Certain surcharges may be payable by you in addition to the fee included in the Quote. When a surcharge is payable, it may be charged directly to the payment method used to make for the Repair (if you have consented to this). If we have not obtained your consent to charge surcharges directly to your original payment method, we will contact you directly to arrange payment.
    2. Any Surcharges represent the additional administrative costs which will be suffered by Kerbi and charges which Kerbi may incur from the Providers and are not penalties imposed by Kerbi.  This information is made available to you prior to a Quote Acceptance.
    3. The full Fee will be applied if, when the Provider arrives at the provided repair location, you are not there and you do not respond to provide a correct /updated location within 15 minutes of the Provider attempting to contact you. No refund will be payable.
    4. If in the scenario when you have elected for a patch service, the provider having examined the inner tube finds that it is is not repairable you will be charged 50% of the service fee.
  6. Provision of the repair
    1. Repair times are not guaranteed. If the Provider is not able to provide the Repair by the latest time set out in the Accepted Quote, the Provider will endeavour to notify you of his arrival time as soon as possible.
    2. The automated system requests repair times as per your Quote Request, with settings of either “immediate assistance” or at a time specified by you for later assistance.  The Quotes you receive will always endeavour comply with those times.
    3. The Provider/Kerbi have the right to refuse to perform a Repair where it differs materially from the information given by you at the time of placing the Order - for example if the Quote Request information sets out the incorrect wheel size, or the Repair is different or additional. In such circumstances the Fee shall be payable and is not refundable
    4. Collections are possible 24/7/365, but are subject to Provider availability in providing Quotes to meet your Quote Request requirements.
    5. On completion of the Repair, you must carefully check the Repair, including the wheel fixings, tyre pressures, and rims – and that the brakes have been properly re-attached and only accept the Repair if satisfied that it is correct. You accept responsibility for the roadworthiness of the bike. By accepting the repair has been completed you accept that your bicycle is safe to ride. Your action in cycling away on the repaired bicycle is proof of acceptance of the proper performance of the Repair. Where accepted the Provider will update the status of the Order as “completed” by sms and/or email. 
    6. Kerbi makes no guarantee as to how long the Repair will last for and no refunds are provided. You are however able to rate the Provider on the App and choose a Provider by rating
    7. The Provider will endeavour to notify you by email, text and/or phone call if there are any issues with him being able to arrive to perform the Repair, even where you have provided incorrect location details.
    8. Kerbi can provide the Repair at roadside or at an office or residential location.
  7. Customer Service Queries

    2. We aim to provide outstanding Customer service. If you have any complaint about the service you have received then please contact us by phone or by email at info@kerbi.co.uk. Should you still be unhappy with how your enquiry has been resolved then a formal response can be made in writing to Customer Services at the postal address listed in 7.1.2. Please allow 28 working days for a response to any written (postal) correspondence.
  8. Limitation of Kerbi's Liability
    1. Kerbi's liability to you is subject to the exclusions listed in this section.  This means that, with certain exceptions, the maximum amount of a claim that you can make against Kerbi will be limited in value.
    2. Nothing in this section seeks to limit Kerbi's liability to you for claims relating to death or personal injury caused by Kerbi's negligence or for any other liability which cannot be excluded by law.
    3. KERBI'S MAXIMUM LIABILITY TO YOU IS LIMITED TO THE FEE PAID FOR THE REPAIR. Kerbi's liability under these terms of use is limited to the contracting party who placed the order.
    4. In any case, to the greatest extent that is permitted by law, Kerbi hereby limits its liability to the direct losses suffered by you (save as expressly stated otherwise in these terms of use).  Accordingly, we will not be liable for any claim for loss of profit, loss of use of an item, loss of revenue, administrative inconvenience, delay, disappointment, or indirect or consequential loss or damage arising out of, or in relation to, the Repair you ordered.
    5. Kerbi will also not be liable for any damage caused to your bike or any third party or third party property arising out of the provision of the Repair and you indemnify and will continue to indemnify Kerbi in respect of any such liability, including all related costs, claims and expenses.
  9. Serverability

    If any part of these terms of use is found to be unenforceable as a matter of law, the enforceability of any other part of these terms will not be affected.

  10. Governing Law

    These terms of use and any contract between us shall be governed by and interpreted in accordance with English Law and the English Courts shall have jurisdiction over any disputes between us.

  11. Statutory Right

    These terms of use do not remove any statutory right which you have as a consumer which cannot be excluded.

  12. Rights of Third Parties

    A party who is not a party to this agreement (such as a receiver) cannot enforce the terms to this agreement, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

You may give us information about you by filling in forms on our site www.kerbi.co.uk (our site) or by corresponding with us by phone, e-mail or otherwise. This includes information you provide when you register to use our site, place a Quote Request and/or accept a Quote on our site and when you report a problem with our site or the Services. The information you give us may include your name, address, e-mail address and phone number. Any financial and credit card information you provide will be held by Stripe. Information we collect about you.

With regard to each of your visits to our site we may automatically collect the following information:

technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;

information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.

Information we receive from other sources.

We may receive information about you if you use any of the other websites we operate or the other services we provide. In this case we will have informed you when we collected that data that it may be shared internally and combined with data collected on this site. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them.

We will store your location data of where you received the Services and the tyre size received, but in each case only on an aggregated basis.

Disclosure of your information

We may share your personal information with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

We may share your information with selected third parties including:

Business partners, suppliers and sub-contractors for the performance of any contract we enter into with you.

Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others.

Analytics and search engine providers that assist us in the improvement and optimisation of our site.

We may disclose your personal information to third parties:

In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.

If Jasmine Technologies Limited or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use (www.kerbi.co.uk) and other agreements; or to protect the rights, property, or safety of Jasmine Technologies Limited, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

Where we store your personal data

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

All information you provide to us is stored on secure servers. Any payment transactions will be performed by Stripe. For details of their privacy policy, visit https://stripe.com/gb/privacy. Where we have given you (or where you have chosen) a password, which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Your rights

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.
